Florida Healthcare Collective ("we," "our," or "us") is a licensed nurse registry operating in the State of Florida under Florida Statute Chapter 400, Part III. We connect patients and families with independent, credentialed healthcare professionals — including Registered Nurses (RNs), Licensed Practical Nurses (LPNs), Certified Nursing Assistants (CNAs), and Home Health Aides (HHAs) — for in-home care services.

This Privacy Policy applies to information collected through our website, patient intake processes, caregiver referral processes, portals, forms, and any other interactions with Florida Healthcare Collective.

Important: Florida Healthcare Collective is a nurse registry, not a home health agency. The healthcare professionals referred through our registry are independent contractors, not employees of Florida Healthcare Collective.

Section 02

Information We Collect

We collect several categories of information depending on your relationship with us.

Patient & Client Information

Name, address, phone, email, date of birth, emergency contacts, insurance information, physician name and contact, care needs, medical history summary, and relevant health conditions.

Caregiver & Provider Information

Name, contact details, professional license number and state, license type and expiration, CPR certification, background screening results, liability insurance documentation, professional references, employment history, and health screening records.

Website & Contact Visitors

Name, email address, phone number, message content, IP address, browser type, pages visited, time on site, and referral source — collected when you contact us or submit a form.

Portal Users

Login credentials (encrypted), session activity, documents uploaded or accessed, scheduling and assignment records, and communication logs within the portal.

Health & Medical Information

Medical diagnoses, care instructions, medication lists, functional limitations, physician orders, and other clinically relevant information necessary to coordinate appropriate in-home care.

Billing & Payment Information

Payment method details, service agreements, invoice history, and records of transactions. We do not store full credit card numbers — payment processing uses industry-standard secure third-party processors.

How We Collect Information

We collect information through the following means:

  • Intake forms completed by patients, family members, or authorized representatives
  • Applications submitted by healthcare professionals seeking referral
  • Telephone calls and email correspondence with our staff
  • Our website contact forms, inquiry submissions, and newsletter sign-ups
  • Our digital portals (patient portal, provider portal, partner portal)
  • Referrals from physicians, hospitals, discharge planners, or partner organizations
  • Background screening and credentialing agencies (for caregiver verification)
  • Cookies and similar tracking technologies on our website (described in Section 9)

Section 04

How We Use Information

We use collected information for the following purposes:

Referral Coordination

To match patients with qualified, credentialed independent healthcare professionals who meet their care needs, location, and schedule requirements.

Credentialing & Compliance

To verify licenses, certifications, background screening results, insurance documentation, and continuing education for every provider referred through our registry.

Communication

To respond to inquiries, confirm appointments and referrals, send care-related notifications, and communicate with patients, families, and caregivers.

Regulatory Compliance

To meet our obligations under Florida Statute Chapter 400, Part III, AHCA licensing requirements, HIPAA (where applicable), and other applicable state and federal laws.

Safety & Emergency Management

To fulfill our emergency management plan obligations and assist patients in registering for Florida's Special Needs Shelter program when applicable.

Billing & Payment Processing

To process registry fees, issue invoices, apply payments, and maintain accurate billing records for services arranged.

Quality Improvement

To monitor service quality, respond to concerns, address complaints, and continuously improve our referral processes.

Website & Portal Operations

To operate and improve our website and digital portals, analyze usage patterns, and ensure technical security.

We do not sell your personal information to third parties. We do not use patient health information for marketing purposes without explicit consent.

Section 05

Information Sharing

We share information only as necessary to operate our nurse registry, comply with the law, or protect safety. We do not sell personal information.

  • Referred Independent Contractors: We share relevant patient care information with the independent healthcare professional referred to you so they can understand and meet your care needs. You will be informed before any referral is made.
  • Regulatory Agencies: We may disclose information to the Agency for Health Care Administration (AHCA), the Florida Department of Health, the Florida Department of Law Enforcement, or other regulatory bodies as required by Florida law or in response to lawful investigations.
  • Background Screening Providers: We share caregiver applicant information with AHCA-authorized Level 2 background screening vendors as required by Florida Statute Chapter 435.
  • Insurance and Billing: We may share information with insurance companies, Medicaid managed care plans, or billing processors as necessary and as authorized by you or required by law.
  • Partner Organizations: With your knowledge and consent, we may coordinate with referring physicians, hospitals, discharge planners, or partner facilities to facilitate continuity of care.
  • Legal Requirements: We may disclose information when required by a court order, subpoena, or other lawful legal process, or to protect the safety of any individual.
  • Abuse, Neglect, and Fraud Reporting: We are required by Florida law to report suspected abuse, neglect, exploitation, or Medicaid fraud to the appropriate authorities.
  • Service Providers: We may share information with trusted third-party vendors who assist us with IT services, data storage, or communications — subject to confidentiality agreements and security requirements.

Section 06

HIPAA & Health Information

The Health Insurance Portability and Accountability Act (HIPAA) governs the privacy and security of protected health information (PHI). Florida Healthcare Collective operates as a HIPAA-covered entity in connection with its nurse registry activities. As a licensed nurse registry that coordinates the referral of healthcare professionals to patients and transmits protected health information in connection with those services, we are subject to the HIPAA Privacy Rule and Security Rule and comply fully with their requirements.

Health information we collect — including diagnoses, care needs, medications, and physician information — is treated with the highest level of confidentiality. It is used solely for care coordination, regulatory compliance, and safety purposes as described in our Notice of Privacy Practices.

We maintain physical, administrative, and technical safeguards to protect health information from unauthorized access, use, disclosure, alteration, or destruction, in full compliance with the HIPAA Security Rule.

Florida Patient Privacy Rights

Florida law provides patients with specific privacy protections. Under Florida's Patient's Bill of Rights and applicable nurse registry statutes, you have the right to:

  • Have your personal and health information kept private and shared only as allowed by law or your authorization.
  • Know who has access to your information within Florida Healthcare Collective and why.
  • Request access to records the registry maintains about your services, subject to applicable legal limits and fees.
  • Receive a reasonable explanation of registry fees and charges and an itemized bill upon request.
  • File a complaint about privacy concerns with Florida Healthcare Collective or with the applicable regulatory agency without fear of retaliation.
  • Be informed when required notice of privacy practices or complaint procedures is distributed by Florida law.

Data Security

We implement reasonable administrative, physical, and technical safeguards designed to protect your information against unauthorized access, disclosure, alteration, or destruction. These measures include:

  • Encrypted transmission of data via HTTPS/TLS for all website and portal communications
  • Access controls that limit information access to authorized staff with a legitimate need
  • Secure, password-protected systems with role-based access for portal users
  • Physical security controls for paper records containing personal or health information
  • Regular review of our security practices and procedures
  • Confidentiality agreements with staff and contracted service providers

Section 10

Retention

We retain personal and health information for as long as necessary to fulfill the purposes described in this policy, comply with legal and regulatory requirements, and resolve disputes.

  • Patient and service records are retained in accordance with Florida nurse registry recordkeeping requirements and applicable HIPAA retention standards — generally a minimum of five years from the date of service or last contact.
  • Caregiver credentialing records are retained for the duration of the caregiver's active status with our registry and for a minimum period thereafter as required by Florida law.
  • Website and contact inquiry records are retained for a period sufficient to respond to and document the inquiry, typically up to three years.
  • Billing and financial records are retained for a minimum of seven years in compliance with state and federal tax and accounting requirements.

When records are no longer required, we dispose of them securely — shredding paper records and permanently deleting electronic records in a manner that prevents unauthorized recovery.

Your Rights

Depending on your relationship with us and applicable law, you may have the following rights with respect to your personal information:

Right to Access

You may request a copy of the personal information we hold about you, subject to identity verification and applicable legal limitations.

Right to Correction

You may request that we correct inaccurate or incomplete personal information we maintain about you.

Right to Restriction

In certain circumstances, you may request that we limit how we process your information, pending resolution of a dispute or concern.

Right to Complain

You may file a complaint with us or with an appropriate regulatory authority without fear of retaliation or adverse action.

Right to Know Disclosures

You may ask us who we have shared your information with and for what purposes, within the bounds of applicable law and operational confidentiality.

Right to Withdraw Consent

Where we rely on your consent to process information, you may withdraw that consent at any time. Withdrawal does not affect processing that occurred before the withdrawal.

Section 12

Children's Privacy

Florida Healthcare Collective provides services to pediatric patients when medically appropriate, and we collect information about minors only as necessary to coordinate their care. Such information is collected with the knowledge and consent of a parent, legal guardian, or authorized representative.

Our website is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13 for marketing or non-care purposes. If you believe we have inadvertently collected such information, please contact us and we will promptly delete it.

Policy Changes

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or the services we offer. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this policy
  • Post the revised policy on this page
  • Notify active patients, caregivers, or portal users by email or through the portal when required by law
